BDAV CPD Seminar, 6 July 2009 A Case Study in Design Negligence
What do identifying discrepancies and inconsistencies on design drawings, 50mm balustrade height error, and $224,825 have in common? Hear why it is important you never underestimate your professional role as a designer!
An article in the Herald-Sun published in February 2009 reported that a toddler suffered severe head injuries when she fell from a mezzine floor of city flats as a result of allegedly squeezing through up-rights of a balustrade and falling several metres onto a tiled floor.
A writ has been issued against the developer, the builder, the designer and the building surveyor. The allegation is that the railings and balustrade did not meet building standards.
The case has yet to be heard.
This report is a timely reminder of a court decision made in 2001: Toomey V Scolaro's Concrete Constructions Pty Ltd (in Liquidation) and Others.
Brian Morison, BDAV's Executive Officer for the past 15 years, and a recognised authority in these matters, will discuss the impact of the Toomey Case and its implications for designers who are accused of negligence. Whilst this is a repeat of a presentation that Brian made to the October 2002 BDAV AGM, the Herald-Sun article is timely for Brian to re-present this very informative Case Study, particularly given the large number of new members who have joined the BDAV since then. Even longer-serving members will find this a timely refresher on the very important issue of design negligence.

Therefore, those who book and do not attend will be required to pay the full fee.
Registrants who book then cancel more than three days prior to the event will receive a refund of their payment,
less an administrative charge of $11 per registrant for paying registrants.
Non-paying registrants who book and do not attend will be invoiced $11 to offset administration costs.
Bookings cannot be transferred to other BDAV events.
